  • Contractual Necessity (Art. 6(1)(b)): When you engage our services, we process data necessary for the performance of the contractual relationship, including billing information and project specifications.

1.3 Categories of Personal Data

We collect and process the following categories of personal data:

1.4 Data Retention

Contact form submissions are retained for a maximum of 24 months from the date of submission, after which they are securely deleted. Contract-related data is retained for the duration of the contractual relationship plus the legally mandated retention period of 10 years for financial records under Spanish commercial law. Technical server logs are automatically purged after 90 days.

1.5 Your Rights Under GDPR

Under the General Data Protection Regulation (EU) 2016/679, you have the following rights:

  • Right to Rectification (Art. 16): You may request correction of inaccurate personal data.

1.6 Data Transfers

Some of our service providers are located outside the European Economic Area (EEA). Refund Policy

3.1 Scope

This refund policy applies to all digital services provided by ValeRelayForge, headquartered at 41907, Calle Alcalde Jose Fuentes Rodriguez 29, Santiponce, Spain. By engaging our services, you acknowledge and agree to the terms outlined in this section.

3.2 Milestone-Based Payment Structure

All projects are invoiced according to the milestone-based payment structure defined in the executed Statement of Work (SOW). Payments become due upon completion and client approval of each defined milestone. Work on subsequent milestones does not commence until the preceding milestone payment has been received and cleared.

3.3 Refund Eligibility

Refunds are evaluated on a case-by-case basis according to the following criteria:

  • Pre-Commencement Cancellation: If a project is cancelled by the client before any engineering work has commenced, a full refund of any advance payments will be issued within 14 business days.
  • Mid-Project Cancellation: If a project is cancelled after work has commenced, payment for all completed and approved milestones is non-refundable. Any prepaid amounts for uninitiated milestones will be refunded minus a 15% administrative fee to cover resource allocation and opportunity costs.
  • Deliverable Non-Conformance: If a delivered milestone fails to meet the specifications defined in the SOW after two reasonable revision cycles, the client may request a proportional refund for the non-conforming portion of the work. Refund amounts are calculated based on the percentage of non-conforming deliverables relative to the milestone scope.
  • Force Majeure: In the event that project delivery is prevented by circumstances beyond either party's control, payments for undelivered milestones will be refunded in full.

3.4 Refund Processing

All approved refunds will be processed using the original payment method within 14 business days of refund approval. Refund requests must be submitted in writing to [email protected] with a detailed explanation of the grounds for the refund request.

Terms of Service

4.1 Acceptance of Terms

By accessing or using the services provided by ValeRelayForge, registered at 41907, Calle Alcalde Jose Fuentes Rodriguez 29, Santiponce, Spain, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you (the "Client") and ValeRelayForge (the "Provider"). If you do not agree to these terms, you must not engage or use our services.

4.2 Scope of Services

The specific scope, deliverables, timelines, and pricing for each engagement are defined in a mutually executed Statement of Work (SOW). The SOW, together with these Terms of Service, constitutes the entire agreement governing each project. Any modifications to the agreed scope must be documented in a written change order signed by both parties.

4.3 Intellectual Property

Upon full payment of all invoiced amounts, the Client receives full ownership of all custom-developed source code, designs, and documentation created specifically for the Client's project. The Provider retains the right to use general methodologies, frameworks, tools, and non-client-specific knowledge developed during the engagement. Pre-existing intellectual property, third-party libraries, and open-source components remain subject to their original licensing terms.

4.4 Confidentiality

Both parties agree to maintain strict confidentiality of all proprietary information exchanged during the course of the engagement. This obligation survives the termination of the agreement for a period of 3 years. Confidential information shall not be disclosed to third parties without prior written consent, except as required by law.

4.5 Limitation of Liability

The Provider's total aggregate liability under any engagement shall not exceed the total fees paid by the Client for the specific project giving rise to the claim. In no event shall the Provider be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

4.6 Governing Law & Dispute Resolution

These Terms of Service are governed by the laws of the Kingdom of Spain. Any disputes arising from or relating to these terms or the services provided shall first be subject to good-faith negotiation between the parties. If a resolution cannot be reached within 30 days, the dispute shall be submitted to the exclusive jurisdiction of the courts of Seville, Spain.

4.7 Modifications

ValeRelayForge reserves the right to update these Terms of Service at any time. Material changes will be communicated to active clients via email at least 14 days before taking effect. Continued use of services after the effective date of modified terms constitutes acceptance of the updated terms.
